Diana Gamage goes to the Courts to secure parliamentary seat!

Parliamentarian Diana Gamage has filed a petition in the Supreme Court seeking an annulment of the decision taken by the Samagi Jana Balawega to lose her parliamentary seat.

Eleven persons including the General Secretary of the Samagi Jana Balawega Ranjith Maddumabandara, the Chairman of the party Sajith Premadasa, the General Secretary of the Parliament Dhammika Dasanayake, the Chairman of the Election Commission Nihal G. Punchihewa and the Commissioner General of Elections Saman Sri Ratnayake have been sited as respondents in the petition.

She has pointed out in the relevant petition that the respondents have acted to deprive her of her party membership due to her vote in favor of the 20th Amendment to the Constitution when it was passed.

The petitioner alleges that the respondents did not act to provide a fair disciplinary inquiry before losing their seats.

She says the decision violates the legal principle of natural justice.

Accordingly, Parliamentarian Diana Gamage has requested the Supreme Court to rule that the decision taken by the Samagi Jana Balawega to lose her party membership is invalid before the law.
