The Manchester High Court through a judgment delivered on 20 July 2020 has ordered the Tamils Forum UK Limited alias the legal entity of the British Tamil Forum (BTF) UK, a pro-LTTE fund-raising diaspora be wound up under the Insolvency Act 1986 and to pay compensation to one Ms Roshini Sivagurunathan, the petitioning creditor, together with legal costs out of the assets of the Tamils Forum UK Limited.
Accordingly, the BTF, which has used the UK based All Party Parliamentary Group for Tamils (APPGT) as its mouthpiece while being excessively committed to the propagation of pro-LTTE ideology and fund-raising through its so called ‘Secretarial’ assistance to the APPGT has now been thrown out by the High Court Judgment.
Earlier in December 2019, the Court ordered the Tamils Forum UK Limited to pay damages to Ms Roshini Sivagurunathan after hearing the petition, filed by her. The paragraph 237 of the judgment stated that there is ‘manipulation of minutes’, ‘distorted recording’, ‘deliberate omissions’ and ‘unscrupulous conduct’ by the BTF in relation to the Roshini Sivagurunathan vs BTF case. The judge also found the BTF to have been involved in direct discrimination, victimization and denial of natural justice against the petitioner and costs and damages in addition to the liability for the already bankrupt BTF which has been ordered to pay £ 70,000.
Controversially, the BTF using the official address of the Tamil Community Association Limited registered under the Industrial Providence Society Act has been enjoying the charitable status and the Tamil Community Association Limited, contrary to its ‘regulated and non-political organization status, has facilitated the bankrupt BTF to stage pro-LTTE political meeting in the premises.
Reports also claimed that the BTF has throughout prevented all other moderate Tamil organizations having any influence on the APPGT since the founding of the APPGT under the chairmanship of Mr Keith Vass MP, the BTF never wanted to incorporate wider Tamil views on the exact ground realities in Sri Lanka.
The BTF, an evolvement of the former LTTE front, British Tamil Association (BTA) and its representation of LTTE flag carrying members in the streets, allowed the BTF to extend its will aggressively without allowing others to have any interactive engagement with the APPGT.
The reports also claimed that Mr Keith Vass MP showed downright hostility towards groups other than the pro-LTTE fronts to engage with the parliamentary group and also that the APPGT has had some backdoor dealings with the BTF.
Prior to that judgement, the British Tamil Forum UK (BTF), visibly hurt after indictment in a statement issued on 22 February 2019 claiming that the BTF facing financial liability to award to the petitioner for ‘injury to feelings and aggravated damages’ and admitted that it was the BTF which was instrumental in framing UN human rights charges against the Sri Lankan state in the UN. Acknowledging the BTF’s failure in resolving a personal dispute with one of its own members over her ‘rights’, it laments having erred on an ‘HR’ issue which the BTF has self-evidently championed in international agencies while raising issues against the Sri Lankan state.
