Sri Lanka Passes Law to Confiscate Unlawful Assets

Justice Minister hints at a land in Malwana

Harshana Nanayakkara, Minister of Justice, announced in Parliament that land in Malwana can be confiscated following the implementation of the Proceeds of Crime Act, which was presented to Parliament yesterday.

The Proceeds of Crime Act was passed unanimously without any amendments. Concluding the debate, Minister Nanayakkara said the act aims to prevent large-scale fraud committed by politicians, public officials, and other individuals.

“Some MPs argue that no one will be punished under this act. However, even without the conviction of a person, the act empowers authorities to acquire, confiscate, or suspend proceeds of crime. It will cover properties obtained through unlawful means,” the Minister explained.

He further stated that a committee, which contributed its expertise to drafting the law, will continue to monitor and evaluate its implementation. The committee will also train and educate all stakeholders involved, including members of the judiciary, police officers, lawyers, and other relevant parties.

According to the Minister, stolen assets hidden overseas can also be recovered under the new law. The procedures for this are outlined in Chapters 141 to 145 of the act.

In addition, an authority will be established to manage properties that fall under this legislation.
