Colombo Additional Magistrate Pasan Amarasena has ordered three respondents, including Bodu Bala Sena General Secretary Galagoda Aththe Gnanasara Thero, to immediately hand over a luxury apartment located in the Bambalapitiya Falcon complex, valued at over Rs. 100 million.
This property was allegedly taken by force from its rightful owner, a woman who had legal possession of the house.
The Magistrate informed the respondents that failure to comply with the order would result in severe punishment under the Criminal Procedure Code. The court, after reviewing the facts presented by the petitioner through her lawyer, found clear evidence that the woman had been in possession of the property and was wrongfully deprived of its enjoyment by the respondents. The Magistrate emphasized that the petitioner was entitled to peaceful enjoyment of the property.
Those held responsible for the incident are Galagoda Aththe Gnanasara Thero, his disciple Dayaseega Thero, and a man named Sylvester, who was reportedly employed as a watchman at the apartment.
The order was issued after the court reviewed a private case filed by a woman named Inoka Chandima Senanayake, a resident of Colombo 4, before Senior Non-Official Magistrate Sandhya Talduwa. In her complaint, Senanayake stated that the luxury apartment in the Bambalapitiya Falcon complex belonged to her father’s sister, who had entrusted her with the responsibility of maintaining it on May 18, 2023. From that day forward, Senanayake had been taking care of the property.
However, according to the complaint, a group, including Galagoda Aththe Gnanasara Thero, arrived at the apartment and forcibly prevented her and her daughter from entering the premises. A few days later, one of Gnanasara Thero’s disciples reportedly called her and pressured her to vacate the house. Following this, she filed a complaint with the Bambalapitiya Police. When she attempted to return to the house, she was threatened by the security guard, Sylvester, who denied her entry.
Due to these threats, Senanayake and her daughter temporarily relocated to the Ekala area. In her complaint, she requested the court’s assistance, seeking legal protection and the restoration of her rights to the property.
