LC payment for Chinese fertilizer further banned !

The Colombo Commercial High Courts further extended the enjoining order till 30th November against the People’s Bank to refrain from release the money with regard to the Letter of Credit opened for controversial Chinese fertilizer.

Additional Solicitor General, who appeared for Ceylon Fertilizer Petitioner, said that the Chinese company ‘Qingdao Seawin Biotech Group Company’, which won the tender to import sterilized organic fertilizer worth over Rs one Billion later rejected with the identification with some pathogens.

Accordingly, the Additional Solicitor General stated in court that although the company needed to ship the sterilized organic fertilizer to Sri Lanka, the relevant company had accepted in the ship’s instruction leaflet that there were microorganisms in the organic fertilizer.

The Additional Solicitor General also said that testing of the fertilizer sample sent by the respondent Chinese company to the National Plant Quarantine Service had confirmed the presence of harmful bacteria and other organisms in some of its fertilizers.

In this situation, he alleged that the respondent Chinese company had not fulfilled the conditions accepted in the tender.
